Member states must implement the EU Pay Transparency Directive by 7th June 2026. Whilst most EU member states already have equal pay legislation, the Directive substantially adds to company obligations. Member states will need to appoint a national body to oversee the new reporting and disclosure procedures, and it is likely that employer payrolls will need to commission substantive new analysis and reporting requirements. Our session will be of interest to anyone who advises clients on employer requirements when operating throughout the EU. For employers based in the UK, the Directive will not apply for employees within the UK but will extend to employees within the wider EU including Republic of Ireland. It is likely however that, as the Directive sets new standards and expectations on gender pay equality, UK businesses will feel some pressure to comply with wider EU norms.

In this session Tim Kelsey will cover the following topics:

  • The objectives of the Directive
  • What is permissible and prohibited regarding pay disclosure during recruitment
  • Comparator pay reporting by employee request
  • Mandatory gender pay gap reporting – what, when and where
  • Joint Pay Assessments to remedy identified gaps
  • Analysis of current member state progress on legislation
  • Comparison with UK requirements

By attending this session, attendees will gain an understanding of the basic requirements of the Directive, and will gain an insight into the approach being taken by a number of member states. This will enable advisers to fully brief clients contemplating an expansion into the EU, and allow for an effective commentary on the likely penalty regime should an employer fall foul of the Directive.

This session will be of interest to anyone with responsibility regarding clients having employees in the EU, including secondees. This includes HR leaders, legal representatives, those offering client payroll services in EU countries, and senior management executives with strategy and compliance responsibilities.

Course level: Intermediate – delegates will be able to provide concise, polished precis on the Directive after attendance.
